Djakarta -- Wakil Ketua Majelis Syuro Partai Keadilan Sejahtera (PKS), Hidayat Nur Wahid mengatakan partainya mendukung keluarnya peraturan Komisi Pemilihan Umum (PKPU), yang melarang mantan narapidana kasus korupsi menjadi calon legislatif (caleg). Hidayat menilai PKPU itu merupakan bentuk komitmen dalam pemberantasan korupsi.

"PKS sangat mendukung segala upaya memberantas korupsi termasuk dikeluarkannya PKPU sebagai tindakan preventif," kata Hidayat di Kompleks Parlemen, Dki jakarta, Senin.

Hidayat menilai PKPU larangan tersebut merupakan tindakan preventif agar sejak dari hulu hingga hilir, proses demokrasi steril dari masalah korupsi termasuk keberadaan eks narapidana kasus tindak pidana korupsi. Menurutnya, aturan larangan bagi eks-narapidana korupsi menjadi caleg sudah tepat, karena masih banyak warga masyarakat yang tidak terjerat kasus korupsi dan berkesempatan menjadi caleg.

"Di Republic of indonesia ini yang tidak pernah terjaring masalah korupsi masih berjuta kali lebih banyak daripada yang terkena korupsi. Kenapa kemudian harus 'ribet' (ribut) dengan mantan napi korupsi yang jumlahnya sedikit," ujarnya.

Selain itu menurut HIdayat Nur Wahid, rakyat Indonesia punya hak asasi untuk mendapatkan calon anggota parlemen di pusat dan daerah yang tidak terkena kasus korupsi. Hidayat melanjutkan, ketika PKPU itu mendapat ditentang beberapa pihak dan menjadi polemik apakah perlu persetujuan Menkumham atau tidak, maka ini menjadi ujian bagi seluruh komponen untuk menegaskan komitmen dalam pemberantasan korupsi.

"PKS mendukung upaya pemberantasan korupsi sehingga sejak awal kami tidak pernah mencalonkan napi kasus korupsi meskipun tidak ada PKPU tersebut," katanya.

Sebelumnya, KPU mengeluarkan aturan yang melarang pencalonan mantan narapidana narkoba, kejahatan seksual terhadap anak dan korupsi sebagai calon legislatif (caleg). Larangan tersebut tertuang dalam Peraturan KPU No 20 tahun 2018 tentang Pencalonan anggota DPR, DPRD Provinsi dan DPRD Kabupaten-Kota yang ditetapkan pada 30 Juni 2018 dan ditandatangani oleh Ketua KPU Arief Budiman di Jakarta, Minggu (1/seven).

Dalam pasal 7 ayat 1 butir 1000 dan h disebutkan bakal calon anggota DPR, DPRD Provinsi, dan DPRD Kabupaten-Kota adalah warga negara Indonesia dan harus memenuhi persyaratan tidak pernah sebagai terpidana berdasarkan putusan pengadilan yang telah memperoleh kekuatan hukum tetap yang diancam dengan pidana penjara lima tahun atau lebih berdasarkan putusan pengadilan yang telah berkekuatan hukum tetap; bukan mantan terpidana bandar narkoba, kejahatan seksual terhadap anak, atau korupsi.

KPU membolehkan para mantan narapidana itu untuk mencalonkan diri dengan syarat mengumumkan status pemidanaan mereka kepada publik.

Hal tersebut tertuang dalam pasal seven ayat 4 yang berbunyi: "Persyaratan sebagaimana dimaksud pada ayat (1) huruf g, dikecualikan bagi: (a) mantan terpidana yang telah selesai menjalani masa pemidanaannya, dan secara kumulatif bersedia secara terbuka dan jujur mengemukakan kepada publik, bukan sebagai pelaku kejahatan yang berulang, serta mencantumkan dalam daftar riwayat hidup; dan (b) terpidana karena kealpaan ringan (culpa levis) atau terpidana karena alasan politik yang tidak menjalani pidana dalam penjara, dan secara terbuka dan jujur mengumumkan kepada publik.

Pengumuman itu dilakukan oleh KPU, KPU Provinsi/KIP Aceh, dan KPU/KIP Kabupaten-kota seperti yang tertuang dalam pasal 38 "KPU, KPU Provinsi/KIP Aceh, dan KPU/KIP Kabupaten/Kota mengumumkan bakal calon anggota DPR, DPRD Provinsi, dan DPRD Kabupaten-Kota yang berstatus sebagai mantan terpidana sebagaimana dimaksud dalam Pasal 7 ayat (4) pada laman KPU".
